Resolution on Prohibition and the Right to Keep and Bear Arms

Adopted by the Libertarian Party of Pennsylvania on April 5, 2024

Whereas, the Libertarian Party of Pennsylvania (LPPA) recognizes the critical intersection of constitutional rights, individual liberties, and federalism regarding the ability of medical cannabis cardholders to purchase firearms; and

Whereas, the LPPA upholds the inviolable rights outlined in the United States Constitution, including the right to keep and bear arms as enshrined in the Second Amendment; and

Whereas, the LPPA acknowledges the lack of federal authority to ban intoxicants without explicit Constitutional authorization, as evidenced by the history of alcohol Prohibition and subsequent repeal; and

Whereas, the LPPA affirms that the right to keep and bear arms is a fundamental aspect of the prepolitical right to life, rooted in natural rights and foundational to the nation’s principles; and

Whereas, the LPPA recognizes the dangerous precedent set by federal encroachment on states’ rights and the Tenth Amendment through arbitrary stripping of constitutional rights based on compliance with state laws;

Now, therefore, be it resolved, that the Libertarian Party of Pennsylvania stands firmly in support of Warren County District Atorney Rob Greene’s U.S. District Court in Pitsburgh/Erie lawsuit aimed at allowing Pennsylvanians holding medical cannabis cards to purchase, possess and bear firearms.

Be it further resolved, that the Libertarian Party of Pennsylvania advocates for the overturning of discriminatory federal regulations that impede the Second Amendment rights of cannabis cardholders, as well as the Tenth Amendment rights of every cannabis-regulating state.

Be it further resolved, that the Libertarian Party of Pennsylvania calls upon policymakers and relevant authorities to uphold the sanctity of Constitutional rights, respect the principles of federalism, and safeguard the prepolitical natural rights of all citizens, including medical cannabis cardholders.

Be it further resolved, that this resolution shall be communicated to relevant policymakers, government agencies, and the public to advocate for the protection of Second Amendment rights for medical cannabis cardholders.
